HC rejects Nalini's plea for release

The Madras High Court toay dismissed a petition for early release filed by S Nalini, who has been sentenced to life imprisonment in the assassination of former Prime Minister Rajiv Gandhi.




A Division Bench comprising Justice K K Sasidharan and Justice R Subramanian dismissed the plea on the ground that the court could not interfere on the issue as


as the matter was been already seized of by the Supreme Court.




Nalini had sought premature release under the 1994 scheme and had later moved the court. The state government had opposed the plea citing pendency of a similar matter in the Supreme Court then.




Nalini had filed the appeal against the 2016 order of Justice M Sathyanarayanan rejecting her prayer for premature release under a 1994 state government scheme under Art 161 (powers of Governor to grant pardon).




Nalini was sentenced to death by a special court for her involvement in Gandhi's assassination at Sriperumbudur near Chennai on May 21, 1991.




The sentence was commuted to life imprisonment after Sonia Gandhi, the former Prime Minister's widow, sought clemency -- for the sake of Nalini's daughter.
