The Madras High Court has asked the principal secretary of the Election Commission to depose before it on October 6 to explain the use of late Tamil Nadu Chief Minister J Jayalalithaa’s thumb impression on poll documents.
The senior Election Commission official would submit the documents relating to the permission given for the thumb impression of Jayalalithaa and how it is in line with the provisions of the Representation of Peoples Act and also the election conduct rules.
Her thumb impression, taken while she was undergoing treatment at the Apollo Hospitals , had authorised party candidate A.K. Bose to contest the bypoll to the Thirupparangundram Assembly constituency in November last year.
When a petition filed by a defeated candidate P Saravanan of DMK came up for hearing, Justice Velmurugan passed the interim orders directing KF Wilfred, principal Secretary of ECI to appear before the court. Saravanan filed the petition challenging Bose’s election.
Justice P Velumurugan asked the principal secretary to explain whether the Election Commission had authorised the doctor attending to Jayalalithaa to attest her thumb impression on the nomination form of AK Bose.
Saravanan had approached the court to cancel the election of AIADMK's Bose from the Thirupparankundram Assembly constituency in the by-election held last year raising doubts on affixing of the thumb impression by Jayalalithaa in his poll documents.
