The Madras High Court on Monday adjourned the case filed by rebel AIADMK MLAs against their disqualification till November 2 and maintained that floor test in house should not be conducted until further orders.
When the pleas filed by the disqualified MLAs owing allegiance to ousted AIADMK leader TTV Dhinakaran, came up for hearing, Justice Ravichandrababu also said the stay on holding the floor test would continue till November two.
Stating that there would be no stay on disqualification of the MLAs, the court also said the Election Commission should not hold any elections to the 18 constiteuncies, which were declared vacant pursuant to the disqualification, till further orders.
Abhishek Manu Singhvi, appearing for the rebel MLAs, argued that the legislators were only against Palaniswami's government and not switched to other party.
Meanwhile, the Madras High Court on Monday issued notice to the Tamil Nadu government on a petition challenging the latter's proposal to convert the Poes Garden residence of Jayalalithaa into a memorial.
When the petition filed by Jayalalitha's niece J Deepa came up for hearing, Justice K Ravichandrabaabu passed the interim order and posted the plea to October 23 for further hearing.
In his plea, Deepa claimed that the Vedha Nilayam residence of her aunt at Poes Garden belonged to her and her brother J Deepak under the Hindu Succession Act, 1956 as they were her legal heirs.
