SC dismisses plea for CBI probe into Jaya's death

The Supreme Court today dismissed pleas, including that of Rajya Sabha MP and expelled AIADMK leader Sasikala Pushpa, seeking a CBI probe or a judicial investigation by an apex court judge into the death of J Jayalalithaa.

A Bench of Justices P.C. Ghose and Rohinton F. Nariman said, "What are we supposed to do here? You have filed a petition under Article 32 (violation of fundamental rights of citizens by the State) of the Constitution... We will dismiss these petitions and if you press it further, we will impose costs on you."

Pushpa had filed a writ petition in the Supreme Court urging the apex court to order for CBI probe into the 'mysterious and suspicious' death of J Jayalalithaa.

Pushpa had announced that she would contest for the party's top post of general secretary which fell vacant following the death of former chief minister and AIADMK general secretary Jayalalithaa

Pushpa had moved the Supreme Court on December 18, 2016 alleging that former chief minister Jayalalithaa's death was "suspicious" as her actual medical condition was not disclosed, no one was allowed to visit her, her funeral photographs showed embalming marks and everything from her hospitalisation to her death "was kept under wraps".

The hearing began with the lawyer for the Tamil Nadu Telugu Yuva Sakthi submitting that Jayalalithaa died under “mysterious” circumstances and it was up to the apex court to address allegations raised in several quarters that there was some foul play. He said the Court should order a CBI probe and then monitor it.
